Introduction

Welcome to Primo Scale! These Terms and Conditions ("Terms") govern your use of the Primo Scale application ("App," "we," "our," or "us"). By accessing or using our App, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, refrain from using the App.

1. Description of Service

Primo Scale is an AR-powered mobile application that uses artificial intelligence and augmented reality technology to provide estimated measurements of objects. The App is designed for convenience and general-purpose estimation.

Key features include:

• Weight estimation using camera and AI analysis (Digital Scale)
• Dimension estimation (width, height, depth) using AR and LiDAR technology (Tape Measure)
• Object counting using AI-powered image recognition (Object Counter)
• Measurement history with thumbnail previews

Important: All measurements provided by Primo Scale are estimates only. The App does not replace certified weighing scales, measuring instruments, or professional measurement tools.

2. User Eligibility

2.1 Age Requirement

By accessing the App, you confirm that you are at least 13 years old. Users between 13-18 years of age must obtain consent from a parent or guardian to use the App. We are not responsible for unauthorized use by individuals under the required age.

2.2 No Account Required

Primo Scale does not require account registration. Users remain anonymous by default. All data is stored locally on your device.

3. In-App Purchases and Subscriptions

3.1 Freemium Model

Primo Scale offers a freemium model with limited free usage. Additional measurements and premium features require a subscription.

3.2 Subscription Plans

Premium subscriptions are available on a weekly, monthly, or yearly basis. Introductory pricing and free trials may be offered at our discretion.

3.3 Payment Processing

Subscriptions are processed through RevenueCat and the respective app stores (Apple App Store, Google Play Store). We do not directly store or process payment information.

3.4 Managing Subscriptions

You can manage or cancel subscriptions through your app store settings. Subscription changes take effect at the end of the current billing period.

3.5 Refund Policy

Refunds are subject to the policies of Apple App Store or Google Play Store. Please contact the respective platform for refund requests.

4. User Content and Conduct

4.1 User Data

Your measurement history and preferences are stored locally on your device and remain your property. You can delete this data at any time through the App settings.

4.2 Prohibited Uses

You agree NOT to use Primo Scale to:

• Violate any applicable laws or regulations
• Attempt to reverse-engineer, decompile, or extract source code
• Use the App for any commercial purpose without authorization
• Rely on the App for precision-critical, medical, legal, or safety-critical measurements
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App (bots, scrapers, etc.)

5. Intellectual Property Rights

5.1 Ownership

All design elements, software, algorithms, and technologies associated with Primo Scale are owned by or licensed to Tech Primo. This includes trademarks, graphics, AI models, AR scanning technology, and measurement methodologies.

5.2 User License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes only.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or precision of any measurement or estimate
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties that measurements will match those of certified instruments

AI-generated estimates may contain errors, inaccuracies, or significant deviations from actual measurements. Always verify measurements with certified instruments when precision matters.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECH PRIMO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any losses or damages resulting from reliance on the App's measurement estimates
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or business opportunities
• Any damages arising from inaccurate weight, dimension, or count estimates
• Any damages exceeding the amount you paid for the App in the past 12 months

You acknowledge that all measurement estimates are approximations and that any decisions based on them are made at your own risk and sole responsibility.

8. Indemnification

You agree to indemnify and hold harmless Tech Primo from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, reliance on measurement estimates, or infringement of any third-party rights.

9. Privacy

Your use of Primo Scale is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Camera and AR Permissions

Primo Scale requires camera access to function. By granting camera permission, you acknowledge that:

• The camera is used for AR scanning, object analysis, and image capture for AI processing
• Images may be sent to Google Gemini AI for analysis
• LiDAR and depth sensor data is processed locally on your device
• You can revoke camera access at any time through your device settings, which will limit App functionality

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted with a revised effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Croatia, without regard to conflict of laws principles.

12.2 Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration or the courts of Croatia, as applicable. You agree to waive the right to participate in class-action lawsuits.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
