Introduction

Welcome to Primo Snake! These Terms and Conditions ("Terms") govern your use of the Primo Snake application ("App," "we," "our," or "us"). By accessing or using our App, you agree to comply with and be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, refrain from using the App.

1. Description of Service

Primo Snake is a mobile application that uses artificial intelligence to suggest a likely identification for a snake in a photograph and to present general reference content about snake species. The App is designed for curiosity, learning, and general reference.

Key features include:

• Snake identification from a photograph you take or choose from your device library, presented as a likely match and never as a confirmed determination
• A general venom classification for the species suggested, taken from published reference literature about that species
• A reference catalog of species with descriptive and indicative range information
• Identification history with thumbnail previews, held on your device
• Collections that let you group saved identifications into folders on your device

The catalog is general reference material about animals compiled from published sources. Descriptors such as medical significance are literature classifications about a species, not an assessment of any bite, any animal, or any situation.

Important: All identifications provided by Primo Snake are suggestions only and are not guaranteed to be accurate. The App does not replace an expert determination by a qualified herpetologist or wildlife professional, and it does not provide medical advice, first aid, or emergency guidance of any kind.

2. User Eligibility

2.1 Age Requirement

By accessing the App, you confirm that you are at least 13 years old. Users under 18, or under the minimum age of digital consent in their country, must obtain the consent of a parent or guardian to use the App. We are not responsible for unauthorized use by individuals under the required age.

2.2 No Account Required

Primo Snake does not require account registration. We never ask for your name, email address, telephone number, or any other contact details. Our analytics and subscription providers do assign the installed App a random identifier, which the Privacy Policy explains. Your identification history is stored locally on your device.

3. In-App Purchases and Subscriptions

3.1 Freemium Model

Primo Snake offers a freemium model with limited free usage. Additional identifications and premium features require a subscription.

3.2 Subscription Plans

Premium subscriptions are available on a weekly or yearly basis. Introductory pricing and free trials may be offered at our discretion.

3.3 Payment Processing

All payments are processed by the Apple App Store or the Google Play Store. We use RevenueCat to validate purchase receipts and manage subscription status on our behalf. We do not store or process payment information.

3.4 Managing Subscriptions

Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your store account is charged on renewal. You can manage or cancel subscriptions through your app store settings. Cancelling stops future renewals; it does not refund a period already paid for, and subscription changes take effect at the end of the current billing period.

3.5 Refund Policy

Refunds are subject to the policies of Apple App Store or Google Play Store. Please contact the respective platform for refund requests. This does not affect any statutory right of withdrawal or refund you may have under the consumer law of your country of residence.

4. User Content and Conduct

Snakes are wild animals and are dangerous independently of the App. You alone decide how you behave in the presence of a wild animal, and the App has no part in that decision.

4.1 User Data

Your identification history and preferences are stored locally on your device and remain your property. You can delete this data at any time through the App settings. On Android, the operating system may include locally stored app data in a device backup to your Google account, according to your own device and account settings.

4.2 Prohibited Uses

You agree NOT to use Primo Snake to:

• Violate any applicable laws or regulations, including wildlife protection laws
• Attempt to reverse-engineer, decompile, or extract source code
• Decide whether to approach, touch, handle, catch, relocate, or remain near any snake
• Support snake handling, relocation, pest control, keeping, breeding, or any other professional or commercial activity involving live animals
• Make or support any medical decision, including whether a bite requires care
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App (bots, scrapers, etc.)

5. Intellectual Property Rights

5.1 Ownership

The software, algorithms, App interface, and technologies associated with Primo Snake are owned by or licensed to Tech Primo. This includes our trademarks, the AI models we use under license, and our identification methodologies.

5.2 User License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes only.

5.3 Third-Party Content

Some photographs and reference data in the App are supplied by third parties under open licenses, including Creative Commons licenses. Each such item is credited in the App with its author, its license, and its source, and photographs are resized from the original. The rights in those works remain with their authors, and their licenses, not these Terms, govern your use of them.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding the accuracy, reliability, or completeness of any identification, venom classification, or reference content
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties that an identification matches the animal in your photograph, or that any animal is what the App suggests it is

AI-generated identifications may contain errors, including naming the wrong species and showing a venomous species as not venomous. The App is a reference tool and nothing in it is safety, medical, or professional advice. Keep your distance from every snake, and contact a qualified wildlife professional, or your local emergency services in an emergency, whenever an accurate determination matters.

7. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects the mandatory rights you have as a consumer under the law of your country of residence.

SUBJECT TO THE PARAGRAPH ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, TECH PRIMO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any losses, damages, or injury resulting from reliance on the App's identifications, venom classifications, or reference content
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, or business opportunities
• Any damages arising from an inaccurate, incomplete, or missing identification
• Any damages exceeding the amount you paid for the App in the past 12 months

Assumption of risk: you acknowledge that every identification is a suggestion that may be wrong, that wild animals are dangerous whether or not you use the App, and that any decision made after using the App is made at your own risk and sole responsibility.

8. Indemnification

You agree to indemnify and hold harmless Tech Primo from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, reliance on identifications or venom classifications, your conduct around wild animals, or infringement of any third-party rights.

9. Privacy

Your use of Primo Snake is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Camera, Photo, and Notification Permissions

Primo Snake requires camera access to function, and you may also choose an existing photograph from your device library. By granting these permissions, you acknowledge that:

• The camera is used to capture images of snakes for AI identification and analysis
• The image you capture or choose is sent to our identification service, which runs on Google Firebase, and is processed by Google Cloud Vision and Google Gemini. We do not store your images on our servers. Google processes the image under its own terms and we do not control how long Google retains it for that processing
• On iOS, the App asks for your agreement before an image is sent for AI processing
• The App requests no location permission and sends no coordinates of its own. It does send a two-letter country code, taken from your manual choice in the App, your device time zone, or your device language, so that results can be weighted towards species found in your region
• A photograph chosen from your device library may still contain location data, a capture time, or device details that the camera which took it wrote into the file
• Public web pages carrying a visually similar image may be fetched through Jina Reader to gather reference text. Only the address of the public page is sent, never your photograph
• The App may ask permission to send you local reminders, for example before a free trial ends. Those reminders are created on your device
• You can revoke camera, photo, or notification access at any time through your device settings, which will limit App functionality

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted with a revised effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Croatia, without regard to conflict of laws principles. This does not deprive you of the protection of the mandatory consumer law of your country of residence.

12.2 Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration or the courts of Croatia, as applicable. You agree to waive the right to participate in class-action lawsuits, except where such a waiver is not permitted by the law that applies to you. Nothing in this section deprives you of the right to bring proceedings in the courts of your country of residence where the mandatory consumer law of that country gives you that right.

13. Apple App Store Additional Terms

The following applies if you obtained the App from the Apple App Store. This agreement is concluded between you and Tech Primo only, and not with Apple. Apple is not responsible for the App or its content, and Apple has no obligation to furnish any maintenance or support for the App.

If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Tech Primo, and not Apple, is responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation, and for the investigation and defence of any third-party claim that the App infringes intellectual property rights.

You confirm that you are not located in a country subject to a United States Government embargo or designated as a terrorist supporting country, and that you are not on any United States Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
